Please read these Terms and Conditions (“Terms”) carefully before using Carhaus.io (“Carhaus,” “we,” “us,” or “our”). By accessing or using the website, creating an account, submitting a listing, or purchasing a plan, you agree to be bound by these Terms.

1. Overview

Carhaus.io is an online real estate platform focused on car-centric properties, including residential, commercial, and specialty automotive spaces. Carhaus provides listing creation, publication, and promotional services but is not a real estate broker, agent, or escrow service.

Carhaus does not participate in negotiations, contracts, or transactions between buyers and sellers.

2. Eligibility & Account Responsibilities

• Users must be at least 18 years old to use the platform.
• You agree to provide accurate, current, and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• Carhaus may suspend or terminate accounts that violate these Terms or applicable laws.

3. Listing Submission & Content Standards

By submitting a listing or related materials, you represent and warrant that:

• You own the property or are legally authorized to market it
• All information provided is accurate and not misleading
• All images, text, and materials are owned by you or used with permission

Carhaus reserves the right to:

• Edit, format, or rewrite listings for clarity, SEO, and platform consistency
• Reject, pause, remove, or decline listings at its sole discretion
• Limit or deny excessive revision requests that exceed reasonable scope

Carhaus is not responsible for errors or omissions originating from user-provided information.

4. Plans, Fees & Payments

Carhaus offers multiple listing plans, which may include flat listing fees, subscription fees, and/or success-based fees, depending on the selected plan.

By purchasing or submitting under a plan, you agree that:

• Plan pricing, deliverables, and fee structures are governed by the specific plan terms presented during checkout or submission
• Some plans may include a success fee if a property sells following initial contact originating from Carhaus
• Fees are non-refundable unless explicitly stated otherwise in writing

Plan-specific terms (including the Starter Plan, Flex Plan, and Success Plan) are incorporated by reference into these Terms.

5. Billing, Renewals & Cancellations

• Subscription plans renew automatically unless canceled before the end of the billing period
• You may cancel subscriptions via your dashboard
• Cancellations take effect at the end of the current billing cycle
• No refunds are issued for partial periods, unused time, or canceled plans

Carhaus reserves the right to update pricing or plan offerings with prior notice.

6. Prohibited Use

You agree not to:

• Post false, misleading, or deceptive listings
• Use the platform for unlawful activity
• Attempt to bypass payment systems or success fee obligations
• Scrape, copy, or reuse Carhaus content without authorization
• Interfere with platform security or functionality

Violations may result in listing removal, account suspension, or termination.

7. No Guarantee of Sale or Performance

Carhaus does not guarantee:

• Property sales or buyer interest
• Listing performance, inquiries, or conversion outcomes
• Accuracy of third-party information or user submissions

All transactions occur independently between buyers and sellers.

8. User Content & Intellectual Property

You retain ownership of your submitted content. By uploading content to Carhaus, you grant Carhaus a non-exclusive, royalty-free, worldwide license to display, promote, and market the listing in connection with the platform.

You may not upload content copied from MLS systems, Zillow, or other platforms unless you have explicit rights to do so.

Carhaus reserves the right to remove infringing or disputed content.

9. Copyright & DMCA Policy

If you believe content on Carhaus infringes your copyright, submit a DMCA takedown notice to:

Your notice must include:

• Your name and contact information
• Identification of the copyrighted work
• A link to the infringing content
• A statement of good-faith belief of unauthorized use
• A statement under penalty of perjury that the information is accurate
• Your signature (physical or electronic)

10. Third-Party Services

Carhaus integrates third-party services, including but not limited to:

• Stripe (payments)
• Google Analytics & Tag Manager (analytics)
• Finsweet (CMS enhancements)

Carhaus is not responsible for outages, errors, or policy changes related to third-party services.

11. Limitation of Liability

To the fullest extent permitted by law, Carhaus shall not be liable for indirect, incidental, or consequential damages arising from use of the platform, including lost profits or failed transactions.

Total liability shall not exceed the amount paid to Carhaus in the preceding 12 months.

12. Modifications to Terms

Carhaus may update these Terms at any time. Continued use of the platform after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
